What is a “Show Cause” hearing in NC?
As it relates to NC Family Law and Domestic court, a show cause hearing is one that takes place AFTER a final ruling is ordered by a Judge, but one party contests that the other party if not following the final order. Therefore, the aggrieved party would bring a motion before the court asking the other party to “show cause” as to why the orders are not being followed. During a “show cause” motion in the Carteret, Craven, and Pamlico County NC Family Law and Domestic Courts, the aggrieved party can ask for the final order to be amended or changed completely. In these cases, a Judge can also order that the aggrieved party’s legal fees be assessed to the party for which a show cause motion is alleged, but this is completely up to the Judge hearing the case. As with all Family Law and Domestic court matters, a Judge will make a ruling based upon best interest of a child where one or more are involved and can find that actions against the final order are justified in the best interest of a child(ren).
Examples of actions that can result in a show cause motion
1) A non-custodial parent can bring a show cause motion before the court when he/she feels that the custodial parent is not allowing him/her to see the child as spelled out in the final order and relating to visitation.
2) A custodial parent can bring a show cause motion before the Carteret, Craven, and Pamlico County NC Family Law and Domestic court when he/she believes that the non-custodial parent is not following the orders of the final order from the Judge.
